Medical conditions tend to "feed upon" one another. Maintaining a balanced perspective on anything is difficult when one is in pain, and the nagging, incessant presence of pain, diffuse and radiating, extending to areas and points of the body where one can no longer specify a particular area because of the widespread extension, makes it impossible to have the requisite focus and concentration necessary to perform one's job. Further, the profound fatigue which results from the daily fight against the pain, where one's energy and reserve of patience for daily social and professional encounters is expended and exhausted such that one must choose between being civil or countering the pain, is something which many cannot understand. At some point, consideration must be given to preparing, formulating and filing for Federal Disability Retirement benefits under FERS or CSRS, from the U.S. Office of Personnel Management. Whether now, or a few weeks from a stated point, becomes an irrelevancy when one suffers from chronic pain, for the Federal or Postal employee who has endured such medical conditions already knows -- whether the doctor concedes it or not -- that one cannot continue in this manner. The physical pain, of course, only serves to exacerbate and feed upon the anxiety -- anxiety which projects future events, financial security (or insecurity), and whether and for how long one's agency or the U.S. Postal Service will look the other way as performance deteriorates and the pervasive whispering campaign by coworkers and supervisors begins. Pain of a chronic nature only invites anxiety; and when the two combine, they serve to exacerbate to an extent where an exponential result is attained, neither explained by the pain alone nor the presence of anxiety, but where the sum of the total exceeds any ability to maintain the balanced perspective needed to continue to perform the essential elements of one's job.

Sincerely, Robert R. McGill, Esquire

The topic of this blog post could command pages and pages of single space text. My purpose is to simply mention and highlight some of the more important parts of a commercial real estate lease that should be on the tenant's radar during its negotiation of the lease with the landlord. Here they are in no particular order:

Commencement Date. If the landlord is going to be responsible for making improvements to the space before the tenant moves into the premises, then the tenant will want to make sure that the commencement date does not occur before the time the tenant is able to begin performing its normal business operations in the new space. Likewise, if the tenant is responsible for completing the improvements, he will want to take into consideration the possibility that the landlord might be responsible for delays in the completion of those improvements and that there is a lease provision allowing for an extension of the commencement date in such event. Also, the commencement date should not occur while the tenant is still paying rent on its old space.

Delay Penalties. If the landlord is responsible for completing the improvements, then a provision should be included to make the landlord responsible for the "holdover damages" the tenant may have to pay at its existing premises.

Operating Expenses. Base year should be the calendar year in which the commencement date occurs (so that the tenant will not pay for any operating expense pass-throughs during the calendar year in which the commencement date occurs). Try to exclude from the landlord's operating costs as many expenses as possible. Negotiate for a cap on increases in operating costs.

Interruption of Utilities or Services and Rent Abatement. The landlord will not give you a rental abatement without a fight. Negotiate for it, especially in the event there is a prolonged interruption.

Indemnifications. Count on the landlord's form requiring the tenant to indemnify the landlord under numerous circumstances. Delete those that go beyond situations where the tenant has control of the circumstance, or at least get the indemnification limited to the amount of the insurance the tenant is required to carry under the lease.

Use Clause. A general office use clause is generally sufficient, but your particular business may require the expansion of the use clause. What about an exclusive use provision to prevent a retail tenant from having to compete with another tenant?

Tenant Default. Although these may be the most difficult provisions to negotiate, they should be scrutinized as there are often items that can be deleted or at least revised so as not to be so onerous.

The above list is certainly not exhaustive. But it should at least be a beginning point for the tenant in its negotiations with the landlord. Be prepared to give up on your smaller revisions, but stand firm on those that can have a significant impact on future business operations.

And now the "disclaimer" (what, you thought there wouldn't be one?). Nothing in this post should be considered legal advice. Let's face it. You don't know me and I don't know you. My aim is simple - to provide the reader with some useful, but general, information about the topic. Do not rely on any information in this post without some assurance that the material is still current and reliable at the time it is read. If you want a legal opinion that has teeth, consult your personal lawyer about your particular circumstances. If you don't have a lawyer and like what you see here, perhaps you should contact my law office to determine if I might be a good fit for you. To do so, simply click on my name above and you will be directed to my website, or you can reach me by telephone at (713) 626-2221. Messages left during non-business hours will be returned no later than the next business day.
Hope is a peculiarly human characteristic; it is both a motivator and an incentive; yet, an unrealistic embracing of it, without reality-based assessments, can lead to a frail sense of overwhelming despondency. Hope is the substantive element of the con-artist; for, the fraudulent plan to defraud another is based upon fostering the believer that -- though it may sound too good to be true -- the hope that human nature is good, and the results of such a scheme would reward one with lasting riches, is the thread which tugs at the unsuspecting and naive. Gambling, the Lottery -- despite the exponential odds against winning, are a testament to the human foible identified as "hope". Do animals possess it? Perhaps in some unstated, inherent way -- that the potential food source will not be as formidable as it may appear. In preparing, formulating and filing for Federal Disability Retirement benefits, whether under FERS or CSRS, from the U.S. Office of Personnel Management, it is often the sense of "hope" which leads to procrastination, a delay to the detriment of the Federal or Postal Worker. Whether the hope that the workplace environment will change; that perhaps, one day soon, a new supervisor will come along; that the medical condition will improve despite the doctor's reticence and reluctance to make eye contact when the question is asked; whether the surgery just prior to, or the multiple history of surgeries, did nothing to feed any realistic assessment of hope; whatever the reasons, yes, "hope" is a uniquely human characteristic, and indeed, that which brings us closer to the angels than the apes below. But in considering Federal Disability Retirement, hope must be combined with other human characteristics -- of pragmatism, logic, analytical assessment, and the ability to plan for the future. Hope, in and of itself, while feeding the soul, fails to feed the body; and as human beings are not quite angels, the practical needs of life must be attended to.

Sincerely, Robert R. McGill, Esquire

Continue reading "FERS & CSRS Federal Disability Retirement from the Office of Personnel Management: Hope versus Pragmatic Assessment"

    <p class="MsoNormal" margin-bottom: 0.0001pt; ">Foreclosures
have dropped since last year, but that doesn’t mean that the economy has
recovered. There are thousands of houses
whose owners have defaulted on the mortgage payments, waiting for the
foreclosure to take place. Many of those
houses are vacant, with lawns unmowed and pipes ready to burst when cold weather
freezes them.

<p class="MsoNormal" margin-bottom: 0.0001pt; ">Yesterday,
the Baltimore Sun reported that new foreclosures have returned to normal
levels, but the old “shadow inventory” hasn’t gone anywhere. http://articles.baltimoresun.com/2012-05-17/business/bal-wonk-fewer-new-mortgage-problems-in-maryland-more-older-ones-20120516_1_mortgage-servicers-foreclosure-cases-foreclosure-process
. The mortgage lenders blame Maryland’s
regulations requiring court filings for foreclosures. But, after the recent robo-signing scandal,
these safeguards seem more necessary than ever and are unlikely to be removed.

<p class="MsoNormal" margin-bottom: 0.0001pt; ">The Sun says
that regulators blame the lenders for the delay in foreclosures. They quote the executive director of the Maryland
Consumer Rights Coalition expressing her concern that the delay in notifying
the homeowners is aggravating the situation because the homeowner won’t know
there’s a problem until the arrearage becomes impossible to pay.

<p class="MsoNormal" margin-bottom: 0.0001pt; ">Foreclosures
came to a halt in late 2010 when it was revealed that thousands of affidavits
and deeds of trust had been signed improperly or not at all. The mortgage lenders resolved this in a
nationwide “robo-signing” settlement in March 2012, but the backlog is still
with us.

<p class="MsoNormal" margin-bottom: 0.0001pt; ">Industry
professionals have been predicting a sudden dam-burst of foreclosures for a year
or more now. When the foreclosures do
increase again, it is likely that housing values will take a hit.

National Distracted Driving Month.
Distracted driving kills more than 5,000 people and injures nearly
450,000 more each year. The majority of
these people are teenage drivers.
Distracted driving can mean not only the use of a cell phone or texting,
but can also be visual such as taking your eyes off the road, manual by taking
your hands off the wheel, or cognitive by taking your mind off the road. Unfortunately, our team of Newnan car accident attorneys sees far too many tragedies that could be prevented with more education and commitment to drive safe.

<p class="MsoNormal" margin: 0in 0in 0pt; text-align: justify;">Texting
and talking on the phone are both mental and physical distractions. Cell phone use is attributed to 18% of the fatality rate of distracted-related crashes. But what makes up the other eight-two percent
82%? This includes reaching over to
grab a drink, changing the music on the radio, putting on lipstick, reading a
roadmap, eating on the go, and many other seemingly “harmless” diversions.

<p class="MsoNormal" margin: 0in 0in 0pt; text-align: justify;">Talking
on the cell phone makes a driver 4 times more likely to have a crash or
a near crash event. Texting makes them
23 times more likely to have this happen. Studies have shown that texting slows driver
reaction time even more than alcohol.

<p class="MsoNormal" margin: 0in 0in 0pt; text-align: justify;">Our
children are inexperienced drivers and it is important to engage them in discussions
of how to drive safely. This would
include driving without texting, driving without making or receiving calls or
texts, and letting your teenagers know to call or text before they start
driving to let parents or friends know when they will arrive. If or when teenagers do receive a call,
instruct them to pull over to the side of the road safely before making or
receiving any calls or texts.

<p class="MsoNormal" margin: 0in 0in 0pt; text-align: justify;">Discussing
distracted driving with your teenage drivers can keep them and others safe.
<p class="MsoNormal" margin: 0in 0in 0pt; text-align: justify;">For more information about safe driving, contact the Newnan, Georgia lawyers of Stemberger & Cummins, P.C. at (770) 253-0913 or wjs@scalawfirm.com

The heart defibrillation leads used in the St. Jude Riata implants were recalled late last year after discovering, the lead had defects in which the silicone insulation will deteriorate, exposing metal wire inside the patient’s body. Recently several studies have found that the rate of defect is significantly higher than estimated last November. In one study, researchers discovered that as much as 33 percent of patients had defective leads that could cause malfunction of the defibrillator, shocking or even killing the patients.

What is an Implantable Defibrillator?

When the heart beats irregularly or stops, a defibrillator is used to shock the heart into beating at a normal pace. In patients at risk of sudden cardiac death from ventricular fibrillation or ventricular tachycardia, a small defibrillator is implanted to monitor heartbeats and correct any abnormalities by delivering an electric jolt. Because a defective implantable heart defibrillator puts patients at risk of cardiac arrest or death, any type of defects in these devices can have fatal consequences.

Health Risks Associated with the Defective St. Jude Riata Defibrillator Leads

Leads are the wire connecting the heart defibrillator to the heart, when the medical device registers abnormalities in the patient’s heartbeat, it sends an electric jolt from the defibrillator to the heart. In the recalled St. Jude Riata defibrillator leads, the metal wiring escapes the silicone insulation, which can potentially result in:

Defibrillation failure

Electrocution

Short circuit cardiac deaths

Electrical malfunction

Unwarranted electrical shocks

Perforation in the heart

St. Jude Medical Device Manufacturing Company

Between 2001 and December of 2010, as many as 128,000 patients worldwide received a Riata or Riata ST implant with a defectively designed lead. Approximately 79,000 of the St. Jude Defibrillators are still implanted in patients who may not realize their heart device is defective and unreliable. If you or a loved one has been harmed as a result of this defective heart defibrillation lead manufactured by Medtronic, you may be entitled to receive compensation.

Contacting a Professional Defective Medical Device Lawyer

Medical device manufacturing companies are willing to invest millions of dollars challenging product liability claims, in order to reduce their financial liability. Because product liability suits against companies like St. Jude are difficult to successfully settle, it is important to entrust your case to an experienced St. Jude Riata Defibrillator lawsuit lawyer. Investors
were unaware that the nest eggs they had entrusted their broker with
were being used to for his personal expenses, including his gambling
debts.

While working as a registered broker for Geneos Wealth
Management, Inc. from 2005-2011, former broker Marc Duda, age 37,
bilked more than 10 , mostly elderly, investors out of millions,
possibly as much as ten million. Duda told these unsuspecting victims
that he was purchasing secure investments while he was actually using
their life savings to purchase a plane, a boat, a car, a motorcycle and
to make mortgage payments, pay child care expenses and even to fund
gambling trips to Las Vegas.

He was able to continue the fraud using the time tested ponzi
technique of paying off old investors with money raised from new
victims. He operated two outside businesses KAD Capital Group, LLC and
Capistrano Beach Funding Corporation, where some of the stolen money
was directed.

He agreed to a permanent bar from association with
any FINRA member. That is the least of his concerns. He was sentenced
to 78 months in prison and begins serving his time on June 22, 2012.
According to Federal Law, Duda will serve a minimum of 85% of his
sentence.

Brokerage firms have a duty to supervise and oversee
the activities of their brokers, however it appears that Duda's firm was
negligent in overseeing his activities, resulting in financial
devastation for many retirees.

If you have a question about the
way your brokerage account has been handled or have stock market losses
that are unexplained, please contact us.
561 391 1900
Free Consultation.
Nationwide Representation.

Rex Securities Law

We may never know if Eduardo Saverin made an informed decision to renounce his U.S. citizenship and risk being denied future re-entry into the United States, in the face of being handed a large tax bill from the U.S. Government. Will he come to regret his decision later? Who knows. But with Facebook's wildly successful IPO, it may have paid to ignore the realities of time and space, notwithstanding any adverse legal implications.

http://tpmdc.talkingpointsmemo.com/2012/05/facebook-eduardo-saverin-ipo-citizenship-singapore-immigration.php?ref=fpa

The Law Offices of Timothy D.
For insurance claims purposes, the most important question to be answered after a multi-vehicle accident is, “Who’s at fault?” The answer
will determine whose insurance is responsible for what. Will the other driver’s
insurance company have to pay for your property damage losses and bodily injury
losses ), or will your insurance be responsible for paying the other driver? Liability
is a legal term that most people understand in a general sense to mean that one
person is legally responsible to pay another person for certain losses. The official statutory statement
of this legal obligation is contained in California’s Civil Code §1714(a),
which states:

Everyone is responsible not only for the result of his or willful acts, but also for an injury occasioned to
another by his or her want of ordinary care or skill in the management of his
or her property or person, except so far as the latter has, willfully or by
want of ordinary care, brought the injury upon himself or herself. Liability
with regard to a motor vehicle collision requires that someone’s conduct
towards you was, at a minimum, “negligent.” Everyone who drives on public
highways or roads owes every person possibly affected a standard of reasonable
care. Basically, you must follow the rules of the road and be careful to avoid
a collision with other vehicles. If a driver of a vehicle fails to live
up to this standard of care, and damages someone else’s property or causes
someone to be injured, he or she is “liable” to compensate the other person for
his or her losses. With regard to driving a car, this general standard of care
owed by drivers is stated as follows: A person must use reasonable care in
driving a vehicle. Drivers must keep a lookout for pedestrians, obstacles, and
other vehicles. They must also control the speed and movement of their
vehicles. The failure to use reasonable care in driving a vehicle is
negligence. (Judicial Council of California Jury Instructions, No. 700.) The
clearest indication that a driver has breached the standard of care is when he
or she has broken one or more rules of the road. In California, our rules
of the road are contained in the Vehicle Code. Almost every driving rule that
you have learned over the years going back to when you were studying to get
your driver’s license for the first time is contained in the Vehicle Code. For
instance, if you enter an intersection on a red light, you have violated
Vehicle Code §21453(a). If you cause an accident as a result, proof that you
ran a red light will establish that you committed negligence by violating this
rule, and you are liable for any damages that are caused as a result. Sometimes
negligence is just as clear without any specific rule being broken. For
instance, if you get struck from behind by another vehicle as you are stopping
for rush hour traffic, it is generally understood that the driver that hit you
from behind is at fault. There is no statute that says it’s illegal to run into
another car from behind. The closest thing to such a law is Vehicle Code
§22350, which says that you must drive at a speed that is safe for the
conditions, and this is a kind of default rule that is routinely cited by
investigating officers when writing a police report for this type of accident. However,
the real standard that most people judge such an accident by is the common
sense idea that a reasonable driver must pay attention to traffic ahead and
avoid hitting other vehicles that slow or stop for whatever reason.

Whether there is liability on the
part of the other driver, yourself, or both, will be determined from the
physical evidence and any witness accounts of what happened. It is therefore
important that you secure as much of the available information as possible
after a collision.

The Demas Law Group has been providing
